FREQUENTLY ASKED QUESTIONS (FAQS)

QUESTION: What does it mean when we say that Mr. Weidman is engaged in the General Practice of law or that he is a lawyer or attorney for families?

ANSWER: It means that during the last 20 years he has gained knowledge, training and experience in many different areas of law relevant to family and business issues. He can handle most General Practice matters himself, but if necessary, he will refer you to someone who is more highly specialized. He will gladly supply a free in-person consultation to sort out your problems.

QUESTION: What areas of law can he help me with?

ANSWER: He can help you buy or sell your house or with troubles from the local building department. Matters of criminal law, felonies, wills, divorce, elder law, trusts, personal injury and incorporation, as well as the subjects listed below in the "Attorney Profile" are all part of his practice.

QUESTION: Are discounted attorney's fees available?

ANSWER: Yes, there are substantial AARP discounts. If you are a member of AARP, you will receive a complete simple Wills package, including husband and wife Wills, Durable Powers of Attorney, Health Care Proxies and Living Wills (eight documents), all for an astonishingly small sum set by AARP. Discounts are also given to senior citizens and elderly persons who are not members of AARP. Many other discounted hourly rates and flat fees are competitive for all clients.

QUESTION: I'm tired of hearing everyone talk about Wills and Estates. Why do I need a Will and Power of Attorney?

ANSWER: A Will designates exactly which loved ones you want to inherit your probate assets. If you have no Will, you run the risk of having your assets pass to an unintended beneficiary, i.e., a divorcing spouse, a disobedient child, ect. A Power of Attorney allows a loved one to handle all of your affairs and sign things for you when you are mentally or physically incapable. It avoids an expensive Guardianship proceeding in court, which can cost more than $10,000 and last for years. Anyone with a home, children or large assets must have at least these documents. They should also have a Health Care Proxy and a Living Will.

QUESTION: If I experience marital difficulties because I am divorcing or am divorced, do I or the children have to suffer because my spouse or ex-spouse is a child support dead beat or because my spouse or ex-spouse holds all the money?

ANSWER: No. You would be surprised with the things Mr. Weidman can do to enforce child support. Anything from garnishing the salary to having driver's license revoked is in the list of many tools available to him. There are ways to have the court force a monied spouse to pay support and attorney's fees to the other spouse and he can help you with this. He can also help unmarried or married persons in Family Court.

QUESTION: When I sell a home or real estate must I pay a big fat attorney's fee simply because my house or property is worth a lot of money?

ANSWER: No. The legal fees to buy or sell a valuable home should not be much more than selling an inexpensive home if the deal is a simple house closing. Your legal fee is determined by many other factors. Mr. Weidman employs various strategies to keep the legal fee down. He can give buyers or sellers insight on the role of brokers, banks, title insurance companies and all others involved in these transactions. The only two people working on your file are Mr. Weidman and a paralegal, Christine.

QUESTION: Must I lose my car and driver's license automatically and go to jail as a criminal  because of a DWI after having just a couple of drinks?

ANSWER: No, and Mr. Weidman can defend the DWI, earn conditional or work driving privileges, lessen the blow and try to get back your car, if it is seized. He can also handle other criminal offenses, including misdemeanors, felonies and can help you with probable cause hearings, Huntley, Dunaway and other constitutional hearings.

QUESTION: Do I have to lose my life savings and have my home taken or liened by Medicaid if my spouse becomes sick and must go to a nursing home?

ANSWER: Not if you plan in advance. Mr. Weidman can help you avoid this by preparing the right documents required for elder law planning, including changes to your deeds, accounts, life insurance and investments. Both state and federal concepts of elder law provide lawful ways to protect you. You can legally change title and transfer property to insulate some or all of your hard-earned assets from being liened or taken by Medicaid.
